GENERAL CONDITIONS OF USE GO ZERO WASTE
These general conditions of use and legal information (hereinafter, General Conditions) regulate the use of access to the gozerowaste.app website as well as the Go Zero Waste mobile application, owned by Go Zero Waste S.L. (henceforth Go Zero Waste) through which the web platform and the mobile application (henceforth the Platform) are made available to users (henceforth User or Users).

The acceptance of these General Conditions assumes a binding contractual relationship between you and Go Zero Waste.

Next, you have at your disposal the conditions that will govern this contractual relationship that establish the use and utilization of the Go Zero Waste Platform in any of its formats, either through the web portal or through the mobile application of service

2. SCOPE OF THE SERVICES

The Go Zero Waste Platform offers customized plans to all companies that promote zero waste and/or the circular economy through their products and services.

The Go Zero Waste Platform offers three types of service:

commercial
Of communication
operational
The user can subscribe to this service through different rates linked to a temporary period. Also, Go Zero Waste offers for free but limiting the use of some of the functionalities of the platform that will only be available to Premium users.

The content and services offered by Go Zero Waste through the Platform refer to aspects related to sustainable consumption, zero waste lifestyle and circular economy. In any case, this content may not be suitable for minors, or for people with special sensitivities or diagnosed illnesses. That is why you are solely responsible.

The users are fully responsible for the access and correct use of their profile and password and other contents of the Platform subject to the legality in force, whether national or international, as well as the principles of good faith, morality, good customs and public order And specifically, acquires the commitment to diligently observe the present General Conditions.

Users will refrain from using the contents of the Platform for illicit purposes or effects that are harmful to the rights and interests of third parties, or that in any way may damage, render useless, affect or deteriorate the Platform, its contents and its services. Also, it is prohibited to prevent the normal use or enjoyment of the Platform to other Users.

Go Zero Waste does not guarantee the level of operation of the internet network or that the service will be unavailable or limited at any time and for any reason beyond Go Zero Waste’s control, whether due to emergencies, connection overload, link failure, network equipment problems, transfers or signal strength. Go Zero Waste is not responsible for data, messages or pages lost or not saved due to performance problems with the internet service.

In addition to the above, and to the extent permitted by law and except as provided in your case in the rest of the general conditions, in no case will Go Zero Waste be responsible for personal, accidental, special, direct damages or indirect, including, without limitation, damages for loss of profits, loss or failure to obtain employment, loss of data, business interruption or any other damage or commercial loss, related to the use or inability to use the application, regardless of cause, regardless of the theory of liability (contractual or non-contractual or otherwise) and even if the user has been warned of the possibility of such damages.

3. USER ACCOUNT

To register as a user of the Platform, you must provide an email address and create a password. The user will be responsible for maintaining the confidentiality of his name and password for the use of the service. The user will not share this information with third parties, and if he does so, he will be solely responsible for misuse, acts or omissions made on the Platform.

The user undertakes and undertakes not to use the content that is at any time available on the Platform in any way that may constitute a violation of any rule or that is offensive to morals, good customs or the image and good name Go Zero Waste professional or its collaborators. Go Zero Waste is not responsible in any case, for the misuse by the user of the contents of the Platform.

The user is aware, and voluntarily accepts, that the use of the Service takes place, in any case, under his sole and exclusive responsibility, so that he will be responsible for damages of any kind that Go Zero Waste may suffer as as a result of the breach of any of the obligations to which it is subject under these General Conditions, Privacy Policy or the applicable legislation in relation to the use of the Service.

4. COMPANY ACCOUNT

If you wish to register as a company on the Platform, you must provide an email address and create a password. The company will be responsible for maintaining the confidentiality of its name and password for the use of the service. The user will not share this information with third parties, and if he does so, he will be solely responsible for misuse, acts or omissions made on the Platform.

5. USE OF THE GO ZERO WASTE PLATFORM

To be a company of the Go Zero Waste Platform and be able to be contractually bound to it, you must be at least 18 years old, as well as have sufficient legal capacity to be able to sign this contract.

The company guarantees that the Personal Data provided is true and accurate, and undertakes to notify any change or modification thereof. Go Zero Waste reserves, without being obliged to do so, the right to request any official information in order to verify the veracity of the Personal Data provided by the User.

6. USE OF THE BLOCK SERVICE

Go Zero Waste can make a blog available to the registered user of the service, in which he can express his opinion and maintain a written relationship with other registered users.

The user undertakes to make appropriate use of these services and will not use them for the following purposes:

Insult, insult, harass, threaten or harass any other Go Zero Waste user or staff.
Use rude, obscene or indecent language.
Perform SPAM.
7 PAYMENT TERMS AND FEES

Go Zero Waste will charge the company for the provision of services the rate that the user has in force at any given time.

There are three types of fees in force for the use of the Platform:

Free monthly fee: €0 / month (VAT included)
Monthly fee: €7/month (VAT not included)
Annual fee: €70 / year (VAT not included)
Any modification of the rates will be communicated to the user at least thirty days (30 days) in advance of the date of their entry into force. The modification of the rates gives the company the right to terminate the contractual relationship with Go Zero Waste.

Once the period of thirty days has passed since the notification of the modification of the tariff, it will be understood that the user has accepted the modifications in the tariffs and consequently maintains the contractual relationship with Go Zero Waste.

The company may select different payment methods. Go Zero Waste will cancel the service if, for reasons beyond its control, it cannot pay the fee to the company through the payment method provided.

8. TERMINATION OF THE COMPANY

The simple removal of the application on your terminal does not in any case imply the termination of the service.

The user can unsubscribe at any time, and will continue to enjoy the Go Zero Waste service until the end of the period that has already been subscribed. Always in compliance with applicable regulations, payments are non-refundable and partial refunds are not provided.

The cancellation and/or cancellation of the service can be done through the «Cancellation» user profile, where the user will only have to follow the instructions to be able to cancel the service, at through a «Unsubscribe» form.

9. INTELLECTUAL AND INDUSTRIAL PROPERTY

All content related to the Go Zero Waste brand, domains, logos, drawings or documentation, including computer programs, or any element that may be subject to protection by intellectual or industrial property legislation, which may be access to users, are the property of Go Zero Waste and all rights of use are expressly reserved.

You may use this material only as expressly authorized by us or those who granted us a license for its use.

Any improper use of the service or its obligations by the user may lead, at the discretion of Go Zero Waste, to the cancellation of the user’s account, or suspension of the service until the incident is resolved, if applicable

Likewise, the user undertakes not to remove, delete, alter, manipulate or modify:

Those notes, legends, indications or symbols that either Go Zero Waste or the legitimate rights holders incorporate into their properties in terms of Intellectual or industrial Property (such as copyright, ©, ® and ™, etc.).
The technical protection or identification devices that the Property may contain (For example, watermarks, fingerprints, etc.).
The user acknowledges that under these General Conditions of Use, Go Zero Waste does not cede or transfer to the user any rights over their Property, or over any property of third parties. Go Zero Waste only authorizes the user to access and use them in accordance with the terms indicated in these terms and conditions.

Users are not authorized to copy, distribute (including e-mails and the Internet), transmit, communicate, modify, alter, transform, transfer or, in any other way, deploy activities that involve the commercial use of the Property, either in character partial or total, without the express consent, granted in writing, of the legitimate owner of the exploitation rights.

Access and use of the Platform will always and in any case be for strictly personal and non-commercial purposes.

Go Zero Waste reserves all rights over the Property that correspond to it including, by way of enunciative and non-limiting title, all the Intellectual and Industrial Property rights it holds over the same.

Go Zero Waste does not grant any other license or authorization of use to the user on its Property other than that expressly detailed in this clause.

Go Zero Waste reserves the right to terminate or modify at any time and for any reason, the licenses granted under these terms and conditions. Without prejudice to this, Go Zero Waste may take legal action against any use by the user that:

Do not comply with the General Conditions of Use specified here;
Infringe or violate the rights of intellectual and industrial property or other analogues of
the company or any other legitimate third party holder; or violates any regulations that
be applicable.

10. INDEPENDENCE OF CLAUSES

If any of the clauses of these General Conditions of Use are null and void or voidable, they will be deemed not to have been applied. The declaration of nullity does not invalidate the rest of the Contract, which will maintain its validity and effectiveness between the parties.

11. APPLICABLE LEGISLATION

These Terms and Conditions will be governed by Spanish legislation, which will apply to the extent not provided in them in matters of interpretation, validity and execution. Likewise, both parties submit, expressly waiving any jurisdiction, to the Courts and Tribunals of Barcelona.

12. MODIFICATION OF THE CONDITIONS OF USE

Go Zero Waste reserves the right to modify this Terms and Conditions document at any time. In the event of any changes to the Conditions, these will be published on the Platform and the date of publication will be indicated, so as to be able to distinguish between the most recent Conditions of Use and the oldest Conditions of Use. in any case, you will receive a notification through electronic means about the update of the Go Zero Waste Terms of Use prior to its publication on the Platform.

Once you receive the relevant notification about the modification of the Terms and Conditions, you can terminate your contract prior to the date on which the new Terms and Conditions come into force or you can choose to continue your access and use of the Platform.
